I believe great lawyers have a distinguishable, cultivating motivation that emanates deep desires within, to put a positive change in motion, to help others grow and thrive, to help others overcome challenges, to inspire personal growth, to inspire courage, and the willpower to commit to a higher purpose.

– Michelle Bevilacqua, Esq.

I am a local native-born and raised in Daytona Beach, and together with my together with my daughters, close family and friends, I still call this beautiful area home. Our family, from all sides of the equation, share a bond that has never weakened. I am blessed and fortunate to have such closeness and support from all. I am immensely proud of the dedication and support to our communities some members have contributed most of their life to. A few have dedicated over four decades serving our local law enforcement communities. Some have risked their lives to serve our country. Some have dedicated many years educating in our community. Some have worked urgently to save lives. It is fair to say I would label each one essential to me.

I stay motivated by helping others learn and grow. I maintain courage by reflecting on the challenges I have overcome. A driving factor for me is knowing someone else is counting on me. I know my daughters, family, close friends and clients count on me every day. Contributing to the positive change and outcome in a person’s life is what fuels my daily dosage of inspiration. But not all my inspirations have come from great happenings; devastating moments endured by myself and family also cultivated and contributed to the beautiful change.

As a family, we have certainly witnessed and lived through our share of injustices. Feeling those firsthand losses propelled me to immerse myself in this career of lifetime learning. Before attending law school, I earned a bachelor’s degree in Forensic Investigations after achieving a minor in Crime Scene Investigations. As one of few attorneys in our community having the advanced training and knowledge in the field of criminal investigations, forensics, and crime scene evidence, I always welcome and enjoy working with and providing assistance to other local attorneys on cases that involve forensic examinations and/or crime scene evidence. Working together diligently is a useful means for finding key answers important to the outcome of a case.

I want and expect answers to several questions myself and many others have, like: How do wrongful convictions happen? How can evidence exonerate a defendant? What rights and liberties protect people from being falsely accused? When is evidence unreliable? How can an attorney protect a client from being wrongfully accused or convicted? Legal issues determined in one case can have a binding impact and influence on future cases. Society needs positive influences and examples if we are to have a brighter, healthier, and prosperous worldly future. It is a privilege and honor to represent and serve my community and our great legal profession. I would like to thank you kindly for your time and consideration.

Forensic Consulting

It is a capital mistake to theorize before one has data. Insensibly one begins to twist facts to suit theories instead of theories to suit facts.

– Sherlock Holmes

Forensic investigations involve the application of forensic sciences when applied in a legal context. This unique branch of science, through various forensic disciplines, employs scientific principles and technological practices to objectively assist with the discovery of legal facts and to provide the trier of fact (be it a judge or jury) with admissible, reliable, and credible evidence to weigh and consider when reaching legal conclusions. Evidence is key when attempting to prove the unproven or disprove the unfounded. Evidence must be reliable, and reliable evidence should adhere to strict principles and procedures throughout all investigative stages.

I am available and offer services to assist other attorneys with questionable evidence and documentation whether it’s by conducting legal research and analyses of forensic issues, explaining the complexities of forensic evidence, assisting with discovery related to forensic evidentiary issues, or co-counseling.

For attorneys, investigating and evaluating possible evidentiary issues in cases offers great insight and benefit. Individual forensic case evaluations serve to ensure the integrity and accurate reporting of all critical evidence presented against the accused. For example, evidentiary issues relating to an investigation might involve several disciplines and key pieces of evidence like:

  • Autopsy reports and findings
  • Agency policies
  • Biases
  • Ballistics
  • Blood spatter analysis
  • Crime scene processing
  • Crime scene reporting
  • Chain of custody
  • Drugs
  • DNA
  • Entomology
  • Error rate probability
  • Fingerprints
  • Hair and fiber analysis
  • Interviews and interrogations
  • Lab accreditations and standards
  • Laboratory information management systems
  • Mobile devices
  • Photographs
  • Questionable documents
  • Supplemental reports
  • Standard operating procedures
  • Safety procedures and protocols
  • Telemetry
  • Trace evidence
  • Transcript reviews
  • Verifications
  • Video evidence
  • Witness statements
  • Witness credentials

I understand and appreciate the importance of trusting in your attorney and knowing your advocate will act with confidence, diligence, and zeal. Clients turn to their attorney to advocate who they are and what they stand for. The outcome of your case depends on the integrity of the evidence presented and the testimony given, and there is no doubt the outcome will directly impact your family’s needs, livelihood, and reputation. Understanding the value of my role, I give my professional commitment to diligently scrutinize the integrity of evidence presented and to reduce the introduction and dependence of faulty, unreliable evidence.
